Rules Enforcement and Fine Schedule
New By-Law Violation Notices

Neighbors have raised the need for the HOA Board to more consistently enforce homeowner bylaws/guidelines. To address this concern, we formed a committee to benchmark the practices of other communities, analyze our current violation notification and fee schedule, and then finally create a simple, enforceable fine and notice schedule for Greenville Overlook (GVOL). The new schedule will be posted on the GVOL website and mailed to every homeowner. The new schedule is effective September 15.
By-law Violation Notice and Fine Schedule
In the occurrence that a homeowner has violated a bylaw/guideline, they will be sent an official Violation Notice by Brandywine Property Management Company stating that they have 15 days to comply with the specific by-law/guideline UNLESS they formally appeal to the HOA Board for an extension. Such an extension will be provided in writing by the HOA Board and ARC Committee and will not exceed 60 days. If the violation is not in compliance by the 15 days (or agreed upon extension timeframe), a fee of $100 will be administered and interest will begin accruing at $25/week until the cumulative fine and interest are paid. If the homeowner does not remedy the violation, including paying all fees administered, legal action will be taken at the 6-month mark and all fines and legal fees accrued will be the responsibility of the homeowner.
In the event of repeat offenses for the same violation, an official repeat violation notice will be sent to the homeowner by Brandywine Property Management Company with a fee of $500. Interest will begin accruing at $25/week until all fees are paid, and the violation is remedied and deemed in compliance by the ARC Committee. If the homeowner does not remedy the violation, including paying all fees administered, legal action will be taken at the 6-month mark and all legal fees accrued will be the responsibility of the homeowner.
Finally, to address continued late payments of HOA dues and to encourage all residents to pay their dues on time, if the semi-annual payment is more than 60 days late, a late fee of $100 will be added to the amount owed.
